Viper's Den v. Jim Morriston - Essay Example Unfortunately, the coffee was not wiped out on time because Flash attended to a phone call before cleaning it up. Jim Morriston was just through with his lunch and had taken two beers with it when he saw Flash and ran over to greet him. Jim Morriston did not see the coffee spill on the floor and neither did he see the bright yellow caution sign that warned of the slippery floor. As he was running towards Flash, he slipped and fell very heavily on the floor as a result of the coffee that had spilled on the floor. As he fell on the floor, he tried to support himself with his hands and ended up fracturing his arm in two places. As a result of this incident, Jim Morriston had to undergo surgery and he ended up spending two days in hospital so that he would be treated of the injuries he sustained from the fall. When Jim Morriston returned to Wyoming, he decided to sue Flash for negligence that led to the fall. A statement of the issues to be decided The major issues that need to be decide d include whether or not Flash has to litigate the case in Wyoming. Another major issue is whether Jim Morriston has a legitimate case of negligence over Flash and the Viperââ¬â¢s Den. In the first issue, Jim Morriston has sued Flash in Wyoming for neglect that led to his fall. He has gone to court right after he returned to his area of residence in Wyoming and has claimed the Flash neglected cleaning wiping off the coffee from the floor which resulted to the injuries and distress that he has today. Since the case is already in court in Wyoming, Flash needs to decide whether he has to litigate the case in Wyoming or not. Flash is of the idea that the state courts in Wyoming are not the proper jurisdiction for this particular type of case. He therefore has to decide whether he will proceed to litigate the case in Wyoming or he will challenge that decision made by Jim Morriston to take the case to the state courts at Wyoming. Another issue that needs to be decided is whether Jim Mo rriston has a legitimate case of negligence over Flash and the Viperââ¬â¢s Den. It has to be decided whether Jim Morriston was the one on the wrong for having taken two beers at lunch. It has to be decided whether the beers that Jim Morriston had taken impaired his sight, reasoning and actions to such an extent that he was not able to see the big bright yellow sign. The coffee spill should have been dealt with immediately so as to avoid any unnecessary accidents from occurring. However, had Jim Morriston been in his right state of mind, there would be higher chances that he would have seen the bright yellow sign and take caution to prevent him from falling. These major issues in this case therefore need to be decided in an attempt to resolve the case and come up with viable and legal solutions to the case at hand (Mallor, Barnes, Bowers & Langvardt, p. 340). Legal arguments that Flash can make against the case being litigated at Wyoming Flash can legally argue that if the reporte d incident took place in Bozeman, then Jim Morriston should have sued him in a court in Bozeman and not in Wyoming. Flash can argue that he does not do any business in Wyoming and the case would therefore lack objectivity if it was to be heard there. During the year (2001 and 2002) the number of poor rose by 1.7 million people. This imbalance is mostly caused by tax cuts which burden the poor more and more. There are complaints that the U.S. laws are unjust as they tolerate oppression of poor people and do not provide them minimum needs. I n Alabama, for example, people who get low income pay higher rate of income tax than those who are wealthy. As an example may be taken the timber industry that has the ownership for 71 percent of the land and pays only 2 percent of the tax. The paradox is that Americans are the richest nation but with the highest poverty rate (Lampman J.). Income inequality which is also among social issues of the U.S. is positively correlated with mental illness, low life expectancy, obesity, drug use, crime and teen pregnancy. Australia is also the country which has documented the growing gap between the poor and rich. The research shows that the most vulnerable Australians have been hardest hit by rising costs for health, education, and public transport services. Pensioners, unemployed, low-income people and aged have faced the harshest rising changes in the living costs. It has also been stated that essential services are placed beyond the reach of the above-mentioned section of the population. Education and medicine have become the services which are sometimes almost inaccessible to many people. The example may be education costs which soared 200 percent above the inflation rate and medical services which are 180 percent above the inflation rate (Holland K., Zimmer E). Inequality in Australia is present in various spheres of life, for example, the average female wage is only 65% of the average wage of a male, and racism is strongly expressed against aboriginals. Inequality is also a characteristic of the polarization of income groups into poor and rich. (Social Inequality in Australia) Hungary is among the countries with low economic growth, decline in wages, and high rate of inflation that has resulted from severe measures, introduces by the government, to make changes in health, educations, and to cut back on the deficit of the government. The above mentioned measures include co-payments in the sphere of health care, tuition at educational establishments. They were intr oduced in 2006 and caused social tension. Poverty of Hungarians is an extreme case of social inequalities. The number of poor is constantly growing. Vast job losses after 1990 caused rapid increase in inequalities and led to privatization and restructuring of wages and prices, and decline in the social transfers value. Declining income security has led to the number of health problems. Hungarians marry late, have few children and in most cases later in life. Life expectancy is also unsatisfactory as citizens live sorter than it would be expected taking into account economic development indicators. Special Education Classroom Essay The purpose of this study is to know whether or not the Discrete Trials Training, one of the main strategies under the Applied Behavior Analysis of Lovaas, is an effective and applicable strategy for special children students especially those who are severely mentally handicapped. Knowing whether or not this strategy is effective for special children, this could be considered as the immediate instruction that will be used by teachers for special children who are mentally handicapped. This study will look into whether there would be progress on the development of a mentally handicapped child when applying the Discrete Trials Training; if results will show that there are improvements on the performance of the student, then this study could be considered as a reference to support the strategyââ¬â¢s effectiveness. Information in this literature review was gathered through the accessibility of various online resources. The online libraries for different researches such as Questia and ERIC libraries were used as search engines to provide various abstracts and overviews of researches about discrete trial training. This literature review also made use of online libraries that specifically contain researches in line with special education. These online sources are Research Autism, Holding Thresholds, Down Syndrome Online, Central Valley Autism Project and Comprehensive information on Autism, Autism Spectrum, and Consulting Services. Different researches that are found to be helpful for this literature review were accessed through these websites. Aside from online research libraries, there are also information used in these literature reviews that were accessed through the website of a university, the University of Wisconsin-Stout. The main motive in conducting such a review is to prove whether the discrete trial training strategy of teaching is an effective way for special children particularly those who have difficulty in generalization of ideas and concepts. Historical Overview It has always been a challenge for special education teachers or instructors to develop new and innovative ways to help special children learn considering their mental capabilities. Special children are called special because they have special and different needs. The demand of educators of special children to posses the most effective strategy in promoting development in the mental thinking of a child is the primary reason why this literature review is done. At this point, there are many strategies that have been discovered by different people, but the question remains: Which one would be the most effective strategy to use? One of the many strategies that could be used in special education classes is Discrete Training Trials which is the main strategy of the Applied Behavior Analysis approach created by Lovaas (Discrete trial training, 2010). If a number of researches have already been done to prove that this strategy would be most effective for the mental development of a special child then more and more schools could adopt this strategy into their own so that the development of a special child can be assured. Relevant Theoretical Literature Since there are a number of strategies that have been developed, the search for the best and most effective strategy to implement inside the classroom is what this review is all about. The strategies that have been formulated have their basis on different learning theories. The Discrete Trial Training strategy is one of the many Applied Behavior Analysis (ABA) approaches. In one literature review, the different behavioral approaches were examined to have their basis on the behavioral theory of Skinner (Benedict, 2007). Considering the behavioral theory of Skinner, Lovaas developed the Discrete Trial Training as a strategy that upholds the view of behaviorists that learning could be acquired through the use of positive and negative reinforcement (Benedict, 2007). This literature reviewed that the learning theory basis of the Discrete Trial Training under the Applied Behavior Analysis is grounded on the behaviorist learning principle which make use of imitation and reinforcement. This literature also reviewed that the children with special needs who experienced such mode of learning had noticeable development (Benedict, 2007). Applied Behavior Analysis in one study is mentioned to be the study of behavior and the manipulation to achieve a desired behavior and reduce and eventually remove an undesired behavior (Choutka et al. , 2004). With the Discrete Trial Training as one of its subsets, this particular strategy is said to monitor skill acquisition by undergoing a one-on-one instruction (Choutka et al. , 2004). The study also talked about how this particular strategy lacks research to support the reliability and effectiveness of such strategy. Relevant Research There has been an occurring question as to whether which strategy to implement is most effective for special children. In one study of the proponent of the discrete trial training strategy, Dr. O. Ivar Lovaas conducted behavior modification treatments for children with autism and after post treatment, results showed progress in the childrenââ¬â¢s comprehension and mental development were undoubtedly apparent (Lovaas, 1987). Results also manifested that this type of procedure could be used for other disorders that children may have, one of which could be schizophrenia (Lovaas, 1987). It is also found in one literature that studied the effectiveness of the discrete trial training for the treatment of children with autism. It is said in this study that the discrete trial training method could be used to advance childrenââ¬â¢s skills and at the same time manage their corresponding negative behavior (Smith, 2001). This research gathered all the necessary information regarding the basic steps of the discrete trial training, the time frame that each child must undergo the said strategy and what other strategies that could be combined with the use of the discrete trial training to further strengthen the development of the child (Smith, 2001). It is also discussed in this study that to effectively implement the discrete trial training strategy inside the classroom, teachers should undergo intensive and specialized training (Smith, 2001). Results showed that though the discrete trial training is a necessary strategy to help children with autism in their mental development, this strategy alone would not be sufficient (Smith, 2001). Though this may be the result of such studies, the researcher believed that there should be more studies and evaluation of the said strategy to further enhance and improve this particular strategy. This study of Smith showed the demand for a thorough evaluation and study of the effectiveness of the discrete trial training as a strategy in the mental development of a child. Another study examined and reviewed other studies, researches on the effectiveness of the discrete trial training as one of the treatment programs for the development of children with autism. This study reviewed how the applied behavior analysis method, most specifically the discrete trial training, is used to treat children with autism (Tews, 2007). After reviewing various studies and results, the review concluded that the method under the applied behavior analysis which is the discrete trial training is one possible strategy to help children with autism (Tews, 2007). Another study discussed the use of the discrete trial training to activate the spontaneity of special childrenââ¬â¢s response (Feeley and Jones, 2008). The study discussed how the discrete trial training provides much possibility to teach children in such a short span of time by using reinforcements to strengthen positive responses (Feeley and Jones, 2008). Results showed that the effectiveness of a strategy should not solely rely on which skill to attend to, rather consider which skill a child must acquire immediately (Feeley and Jones, 2008). Implications for Practice These researches showed that there is a need to continuously study and evaluate strategies and programs that would be implemented inside the special education classrooms. The researches showed inconsistent results, which give it more reason to further give emphasis on the study whether the discrete trial training is indeed an effective strategy to improve the mental development of a special child. Though there have been numerous studies and researches about the effectiveness of such strategy, these studies also pose questions that seem to be unanswered until now. This only implies that though this strategy has already been implemented to other special education classrooms, the inconsistency of the results should be considered as a sign that this strategy is not applicable for every child. Implications for Inquiry Though there are a number of studies about the effectiveness of the discrete trial training strategy to improve the mental development of a child with special needs, there is a noticeable inconsistency with the results of these studies conducted. This means that there is still a great deal of further research to be done and consistent results should be seen to prove that discrete trial training is indeed an effective strategy to use for the mental development of a special child. Summary The studies that are cited in this review of literature examined whether the discrete trial training is an effective strategy to use for the mental development of a child with special needs. In this study, there will also be adaptations as to how this strategy is implemented to special children in other researches. There will be interventions using the discrete trial training for the development of special children. Before and after the discrete trial training is implemented, the performances of each child will be compared and the result of this comparison will serve as the findings and conclusion of this study. This study would most likely be the same as that of previous studies as regards to the effectiveness of the discrete trial training; however most of these studies require further studies as well. Importance of Profit in Business Profit acts as a vital role in the functioning of the economic system. In any industry profit acts as a signal that buyers want more output from that industry. Profits provide incentive for firms to increase production and encourage new firms to enter into that industry. The profit cannot be seen as a selfish motive of any business but induces entrepreneurs to take long business risk. Unless there are no prospects of generating profit entrepreneurs will not devote time and invest resources in any business activity. It encourages firms to develop new products to lower production cost and to provide better services to the consumers. Profit is also expands business activity of the organization. Profit generated from the business reinvests again to expand production or invest into new business. So it allows the firm to continue to business operation. Entrepreneurs can only be motivated to expand its business when it can successfully generate profits from its business operations. The objectives of business objectives besides profit are facilitative objectives and are meant to be subservient to the profit motive. It can be pointed out that private enterprises are operated on behalf of and for the benefit of the owners. It can be advocated that the owners who have assumed the business risk of investing their funds should get suitable return in terms of profit. It is a reward for the entrepreneurs to share the owning and operating business and also serves as a stimulant for business effort. In any business organization profit is treated as a financial yardstick for measuring business efficiency and for evaluating managerial competency. It evaluates how well the decisions and actions of managements turn out to be effective and how well unwise resources to maximize value for the organization. Profit is the main indication how competitive be business organization is. Business efficiency is often expressed as price- Earning, profit to sales volume, earning to capita l employed, earning per share and so on. It is directly or indirectly released to profit generated by the business organization. Outside investors also equate profit with the degree of business efficiency and managerial competence and commit their funds in light of such equation and other related assessments. So the manger uses its resources and engages in activities designed to increase its profits so long as it stays within the rules of the game. The directors of companies have a fiduciary responsibility to act in the best interest of the shareholders. The managers are agents of the shareholders and therefore have a moral obligation to manage the firm in the interest of the shareholders, which obviously is to make as much money as possible and maximize shareholder wealth. The shareholders are the owners of the organization and therefore the profits belong to them. The firms objective is also to finance companys growth, create value not only for its shareholders and also create wealth for all the stake holders for the society. Profit provides resources required to achieve the corporate objectives. As business is a continuing entity it must grow and expand for its sustainability and profit allows the firm to reinvest in new and emerging business opportunities. Profit is highly correlated to generating cash, which brings more flexibility to the business at a lower cost. Stockholders (owners) have a financial interest in the business and obviously expect financial return. The business affects their livelihood because they need money to live and purchase material things. In a market characterized by many firms competing with one another, above normal profits provide important signals, but are not likely to be maintained over long periods of time. That is firms already in the market respond to higher profits by increasing output and new firms will have an incentive to enter the market as well. The result will be on an increased supply of the product, lower prices and ultimately lower profits. The result in competitive markets is that profits provide important signals but are somewhat transitory in nature. It can also be argued that a manger of a business organization has a direct responsibility to his/her employers to conduct business in accordance with their desire usually to make as much money as possible. Elasticity An important concept in understanding supply and demand theory is elasticty and it has a profuound impact on the profit of an organisation. In this context, it refers to how supply and demand change in response to various stimuli. The elasticity of demand measures the responsiveness of demand to changes in a factor that affects demand. Elasticities can be estimated for price, income, prices of related products, and advertising expenditures. The own-price elasticity is the ratio of the percentage change in quantity demanded to the percentage change in price, and is a negative number. Demand is price elastic if a 1% increase in price leads to more than a 1% drop in quantity demanded, and inelastic if it leads to less than a 1% drop in quantity demanded. Price Elasticity of Demand A Price change can either increase or decrease total revenue, depending upon the nature of the demand function. The profit of the firm depends upon the sales revenue of the firm and sales revenue is subject marked demand and price of the product. Here Price Elasticity of demand plays a crucial role and determines the level of real demand of the product. Price Elasticity of demand mans responsive of the consumer towards product when there is a change in the price of the product. Price Elastic of Demand = % Change in demand / % Change in Price. The firm needs to consider aspects of their pricing whether they want to aim for a large market share with a low price. In this case they would want to consider market penetration as a pricing strategy. This would mean setting a low price (and correspondingly lower profit margin on each unit), but selling a higher volume. This depends considerably on whether the product is elastic in demand. If the product of the firm is highly elastic, any increase of the product will affects its sales in the market. For example when a firm decides to increase the price of any product which is highly elastic, the consumers demand for the product will decline in the market and in result affects the sales of the product in the market and consequently to the hampers the profit of the firm. If the product is highly inelastic the consumer usually doesnt respond to any increase or increase in the price of the product in the market. So if the firm increases the price of an inelastic product, it does not af fect the sales of the product significantly but on other hand it increases the sales revenue of that product. It should be kept in mind that high sales revenue does not necessarily mean high profit. The firm has to decide at what price the firm will attain maximize profit (when marginal revenue = marginal cost). Income Elasticity of Demand The income elasticity for a firms product is a crucial force of the farms success (profit) at different stages of business cycle. During the period of economic boom incomes are raising and demands for various products including the firms product increases in the market. As a result revenue of the firm increases and consequently firm generates profit from the product. During period of economic recession, it affects the sales performances of almost all industries across the broad as incomes of the consumptions decrease. The firms product does not find demand in the market. It leads to price reduction and lower sales revenue of the firm. Firms also have to incur various costs on marketing and advertising to woo customers. As a result profit of the firm suffered. Income Elasticity can be either positive or negative when income elasticity in negative, an increase in income is associated with a decrease in the quantity demanded of the good or service. Firms producing cheap goods, its profit is adversely affected when incomes of its targeted customers increase. The consumers switch over to better goods when their income increases and consequently sales of the firm affected adversely and so the profit. Similarly income elasticity is positive but less than or equal to the percentage change in income. Such goods and services referred to, as necessities demand for those goods is not longer affected by change in income. The sales of essential goods is generally unaffected by change in income of consumers and its profit depend on its pricing policy. But it must be remembered that government regulates directly or indirectly prices of essential goods in the market. In case of luxury goods the change in demand is proportionately greater than the change i n income. As individuals become richer, they have more income to spend or luxurious products and services. The sales of luxurious goods increases, as incomes of the consumers increase in the economy and it favorable affects the profitability of the firm. Labour Productivity and Profit Improving productivity is the most direct way to increase productivity. In business particularly in manufacturing industry wages of labour is a large share of cost production. Improved labour productivity curtails costs of manufacturing come primarily from. Improved productivity reflects two types of activity changes: Fewer people doing the same amount of work (due to automation and capital substitution), and reducing the number of employees necessary to reach a given level of sales (due to increases in labor productivity). In other words, greater labor productivity reduces the costs of operation for a given level of production, distribution, sales, makes it feasible to make higher profits from the business. Rapid productivity growth allows businesses to pad profits or boost pay without facing a need to raise prices for their products or services. As productivity slows, profit margins could erode unless businesses pass along their increased production costs to consumers. Profit shari ng is a form of labor compensation in which the employees get higher wages when company profits are higher. The idea is that profit sharing increases the incentive to work harder and work smarter, and thus increases profits. On the whole, the studies confirm this, showing that there is at least some scope for increasing profits through the productivity effect. Now let us assume that the firm introduces a new system of working that leads to a rise in output per worker from 2000 to 2500 per year. It may not necessarily imply that the workers are working harder; it could be that they are working smarter. Cell production for example, is one way in which waste can be reduced in terms of time spent moving units from one part of a factory to another and from one worker to another. It could be that the firm has invested in machinery that is more efficient or has reorganized the production line in some way. Of course, the workers might want extra money in return for these changing working practices so let us assume that they have been offered a pay rise of 5% taking their annual salary to $15,750 per year. The total cost of labour is now 50 x $15,750 = à £787,500. Output however has risen from 100,000 to 125,000. The cost per unit therefore is now $6.30. Even if the firm continues to sell its product at the same price as before it has increased its profit margin. The purpose of the business is to maximize profits. But thatââ¬â¢s not the purpose for other stakeholdersââ¬âfor customers, employees, suppliers, and the community. Each of those groups will define the purpose of the business in terms of its own needs and desires, and each perspective is valid and legitimate. It is also simply good business for a company to cater to its customers, train and retain its employees, build long-term positive relationships with its suppliers, and become a good citizen in its community, including performing some philanthropic activity. Queen Elizabeth and her Conflicts Essay -- Royalty
Queen Elizabeth I was one of the most famous monarchs along with being one of the most successful woman rulers in history (Rowse 243). During her reign, she is said to have kept a long and eternal peace. Wikianswers believes that the main conflict she had during her reign was, ââ¬Å"the aspects of the catholic religionâ⬠. Yes, religious settlement of England needed to be established, but her throne was in danger of her sister in the start and the intrusion her cousin later had greatly impacted and challenged Elizabeth. These are the obstacles I think she more had to battle during her reign. But she wasnââ¬â¢t always first in line for the royalty seat. Elizabeth was the child of King Henry and Anne Boleyn (Galli) born in the year 1533. King Henry had a previous wife named Catherine of Argon with whom they bore Mary in the year 1516. King Henry of course wanting a male heir kept trying and finally had a boy in 1537 with Jane Seymour named Edward VI. Edward was concluded to inherit the throne but died at a young age leaving Mary I of Henryââ¬â¢s children to be next in line (Galli). King Henry lived to the age 55 and passed due to bad health. This was the year of 1547 and Mary being the successor, became queen. Mary I ââ¬Å"suffered terrible childhood of neglect, intolerance, and ill healthâ⬠, says Galli. In her years she went from having high status, to loosing it all from a law change, to receiving it all back and reinstating her to the throne. Her major goal once queen was to reestablish Catholicism and was very committed. A basic existential anxiety makes them want more resources than they can consume (the "just in case" principle). This raises the question of fairness, a.k.a. "distributive justice". How should resources be allocated in a manner which will conform to one or more just principles ? This apparently simple question raises a host of more complex ones : what constitutes a resource ? what is meant by allocation ? Who should allocate these resources or should this better be left to some Adam Smithean "invisible hand" ? Such an invisible hand (working through the price mechanism) - should its mode of operation be guided by differences in power, in intelligence, in knowledge, in heritage ? In other words : what should be the entitlement principle, how can it be determined who is entitled to what ? Everything constitutes a resource : income, opportunities, knowledge, brute power, wealth. Everything, therefore, is subject to distribution to individuals (natural persons), groups of people, certain classes. There are many bases for distribution, but the issue is HOW JUST these bases are and how can we ensure that we are distributing resources using a just distribution base. We all face opportunities to acquire resources. In a just society, everyone is granted the same access to these opportunities. Access does not translate into ability to make use of it. Idiosyncrasies and differences between accessees will determine the latter, i.e. the outcome of such access. The ability to use is the bridge between the access and the accumulated resources. Given access and the capacity to utilize it - resources (material goods, knowledge, etc.) will accrue to the user. There is a hidden assumption in all this : that all men are born equal and deserve equal respect and, therefore equal treatment.

An Unforgettable Memories Event:Watching a concert My unforgettable memories event was watching my favorite singer group:Super Juniorââ¬â¢s concert. For me,a 16 years-old student at that time,it was so excited and unimageble to me to see my favorite idols with my own eyes. I even couldnââ¬â¢t sleep easily at the night before. On that day,I was bubbling with excitement and went straight to the venueââ¬âTaipei Arena. When I first arrive at the venue,I was astonished because of a great of crowd of people there. It was really a surprise to me that so many people were also their fans like me and most of them were at the same age like me.When we got in and sit our own seat,the lights were turned off and the staff anouced that the show was about to begin. And all the fans there lit on their Sapphire Blue light stick,which is Super Juiorââ¬â¢s symbolic color, and the venue was filled with this color,like a pure blue ocean under the moomlight. When singers started to sing,fans sing with them and shout the slogan between the lycris loudly and with one accord. It made me feel their vigor and spirit. Most importantly,when I finally saw the singers with my own eyes,my heart almost leaps out with excitement!I saw the people who were always on the youtube or TV,now they are stand in front of you vividly! It couldnââ¬â¢t describe how excited I was then on the paper,but it still stay in my mind with high-definition till now. Many people think that go to a concert for idols is stupid and itââ¬â¢s making track for the star,but it was still a special mempry for me. And it noticed me that if you like a singer or a group,you should go to one of their concert to feel how their live show bring you and you will never get disappointed. It will be an unforgettable memoris ever in your life!
